Terms and Conditions of Use of the Loyalty Program « Engie Vianeo+ »

These Terms and Conditions of Use (hereinafter the “T&Cs“) define the operating conditions of the loyalty program called “ENGIE Vianeo+” (hereinafter the “Loyalty Program” or the “Program” or “ENGIE Vianeo+“) reserved for natural persons using the ENGIE Vianeo charging service and holding a customer account on the ENGIE Vianeo Application (hereinafter “Customer Account” or “Application“).

This program is operated by ENGIE MOBILITES ELECTRIQUES, a French simplified joint-stock company with a capital of €54,880,000, registered with the Nanterre Trade and Companies Register under number 909 073 363, with its registered office located at 1 place Samuel de Champlain – 92930 Paris La Défense Cedex. ENGIE Mobilités Electriques operates under the brand ENGIE Vianeo (hereinafter “ENGIE Vianeo“).

The ENGIE Vianeo+ Program is a points-based program that rewards users who regularly charge electric or plug-in hybrid vehicles (hereinafter the “User” or “Users“) at ENGIE Vianeo charging stations identified on the map accessible via the Application.

User enrollment in the Program is subject to acceptance and compliance with these T&Cs and the ENGIE Vianeo Privacy Policy.

1 – Conditions for joining the Loyalty Program

To join the Loyalty Program, the User must:

  • Be a natural person of legal age with legal capacity;
  • Have a Customer Account on the ENGIE Vianeo Application;
  • Provide the following information upon registration: last name, first name, country of residence, and a valid email address.

Any User who has created a Customer Account on the ENGIE Vianeo Application will be automatically enrolled in the Loyalty Program.

Enrollment in the Loyalty Program is done exclusively via the Application. It is personal and nominative.

Enrollment in the Loyalty Program is free, except for internet connection costs required to use the Application. Internet connection fees are the sole responsibility of the User.

Upon enrollment, the User may benefit from the advantages described below.

2 – Program Operation

2.1. Accumulation of Loyalty Points

The Loyalty Program allows the User to accumulate points during each charging session carried out exclusively via the Application and on the ENGIE Vianeo charging network, under the following conditions: €1 spent = 1 loyalty point (rounded down to the nearest euro of the charging amount).

Points will be available immediately after the charging session, unless technically impossible.

Each validated registration will result in the allocation of 20 free loyalty points.

ENGIE Vianeo may also occasionally offer additional benefits, the terms of which will be communicated during promotional campaigns.

Loyalty points have no monetary value, cannot be exchanged for cash or their cash equivalent, and are non-transferable.

The User may only use loyalty points that have been accumulated and are actually available in their balance.

2.2. Validity period of points

Accumulated loyalty points are valid for 12 months. If not used within 12 months of acquisition, they will be deleted.

2.3. Checking Point Balance

The User can check their current valid point balance at any time and free of charge in the “My Account” section of the Application.

2.4. Points concellations

Points credited following a charging session that has been refunded will be canceled and debited from the User’s loyalty account.

2.5. Charging summary

After each charging session carried out via the Application, the User will automatically receive by email a summary of the session details, including the charging location, amount, duration, kWh delivered, and number of loyalty points earned.

3 – Obtaining rewards

For every 200 points accumulated, the User will automatically receive a loyalty reward.

This reward will be credited to the User’s Customer Account in the form of a discount coupon worth five (5) euros.

4 – Using rewards

Rewards credited to the User’s Customer Account will be automatically applied to the next charging session carried out on the ENGIE Vianeo network via the Application.

Rewards are valid for 90 days from the date of acquisition and must be used before this period expires.

For each reward used, the point counter will be debited by 200 points, corresponding to the value of the reward used.

Rewards are nominative and non-transferable.

5 – Program duration

Program membership is indefinite, subject to termination by the User or ENGIE Vianeo.

Any User who has not used the Program for 12 consecutive months may have their membership terminated by ENGIE Vianeo.

6 – Modification, suspension or termination of the Program

ENGIE Vianeo reserves the right to modify, suspend, or terminate the Program benefits at any time and without notice, including the point accumulation terms, without justification and without any compensation. ENGIE Vianeo invites Users to regularly consult these T&Cs, accessible via the ENGIE Vianeo website and Application.

ENGIE Vianeo also reserves the right to suspend or terminate the Program, subject to prior notice to the User one month in advance by mail or email.

In the event of permanent termination of the Program, the User will be informed by mail or email and will not be entitled to any recourse against ENGIE Vianeo for any reason. Users who have accumulated enough points may use their acquired rewards within one month from the notification of the Program’s termination. If not used, the points will be permanently lost.

ENGIE Vianeo shall not be held liable for any direct or indirect consequences of anomalies or malfunctions of the Program, its modification, suspension, or permanent termination, for any reason. However, ENGIE Vianeo will make its best efforts to preserve each User’s accumulated points in case of malfunction.

7 – Personal Data

As part of the Loyalty Program, ENGIE Vianeo, acting as data controller, processes User data in accordance with Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

Some data processing is strictly necessary for contract execution or based on ENGIE Vianeo’s legitimate interest. User data may also be processed based on the User’s consent.

ENGIE Vianeo processes the following personal data:

  • Identity and contact data;
  • Points and rewards history;
  • Charging session history and details: location, amount, duration, kWh delivered;
  • Data related to acceptance or refusal of commercial solicitations;
  • Email usage data: opening, clicks, etc.

Personal data collected under the Program is processed for the following purposes:

  • Customer relationship management;
  • Commercial prospecting;
  • Statistics, reporting, and performance indicators;
  • Management of Program benefits and services;
  • Newsletter subscription management;
  • Handling of data subject rights requests (access, rectification, objection);
  • Internal analysis and service improvement surveys;
  • Fraud prevention management.

Data strictly necessary for Program participation is collected directly from the User. Failure to provide such data will prevent ENGIE Vianeo from enrolling the User in the Program.

Users may oppose cookie placement and disable cookies already placed at any time.

Users have the right to access, rectify, obtain additional information, erase, restrict, object to processing, and port their data, under applicable data protection laws.

Users may also file a complaint with a competent supervisory authority.

8 – Fraud and Program exclusion

Any points fraudulently acquired will be automatically canceled.

In case of fraud or attempted fraud, ENGIE Vianeo reserves the right to exclude the User from the Program.

Generally, any behavior detrimental to ENGIE Vianeo’s interests will be sanctioned.

10 – Other provisions and applicable law

If any provision of these T&Cs is found to be invalid, null, illegal, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

The applicable law is French law, unless mandatory provisions of Regulation No. 593/2008 of June 17, 2008 (Rome I) dictate otherwise. This choice of law does not affect the application of consumer protection regulations from the User’s habitual residence if more favorable.

In case of dispute, the User may submit a written complaint to ENGIE Vianeo using the contact details in the “Information” section.

After contacting ENGIE Vianeo, if the User is not satisfied with the response, they may refer the dispute to the Consumer Mediator:
